Prior to July 2017, child support in Illinois was calculated using a percentage of the net income of the non-custodial parent. However, the law changed on July 1, 2017, and Illinois now uses an "income shares" model of child support that bases the amount of support on both parents' net incomes, as well as the amount of parental responsibility and parenting time that each parent enjoys with their children.
In the new model, tables provided by the Illinois Department of Healthcare and Family Services will be used to determine a basic support obligation, which is the amount that parents would typically spend to care for their children at their combined income level. The basic support obligation will be allocated between the parents according to the percentage that each parent contributes to the combined income. If children spend at least 40% of the time with each parent (that is, if each parent has at least 146 overnight stays each year), this will be considered Shared Physical Care, and further calculations will be made to divide the basic support obligation between the parents based on the percentage of time they have with their children.
Courts may also require either or both parents to contribute towards the children's health insurance premiums, daycare expenses, curricular and extracurricular activity fees and costs, as well as college, trade or vocational school expenses.
