Illinois Sole Custody and Joint Custody-Batavia Attorney
Illinois law recognizes both sole custody and joint custody. In sole custody situations, one parent has the legal authority to make the important decisions concerning their child’s health, education, religious upbringing and the like. Joint custody involves a parenting agreement outlining a required process that parents must follow when trying to achieve a jointly agreeable consensus concerning these decisions. Custody arrangements do not necessarily dictate the amount of time each parent has to spend with their child. If parents are unable to put aside their differences with each other, from experience, joint custody may not be a viable alternative as reasonable communication and cooperation respecting major child rearing decisions will be doomed to failure. The court systems have adopted various rules and protocols designed to encourage parents to solve their custody/visitation issues outside of the adversarial courtroom whenever possible. Most judges would say that whenever possible, the parents through their attorneys, should resolve these issues. Mandatory educational classes and mediation are some examples. Ultimately, the court can appoint an attorney as a child’s guardian ad litem, attorney or child’s representative where resolution of disputes seems impossible. Van will make all efforts to ensure that his client’s parental rights and privileges are protected, both prior to and after a divorce is finalized. Helping his client to identify and clarify "best interests" factors is usually helpful and appreciated from feedback received over several decades of family law litigation experience.
